Slip and Fall Accident Claim for Glasgow Hospital Employee

In July 2020, our client suffered a workplace accident. She was employed by NHS Greater Glasgow and Clyde (NHSGGC) at the time. Following an enquiry to her union, Unison, the NHS employee was referred to Thompsons so we could represent her during her slip and fall accident claim.

The background

On the day of the incident, our client was due to be working in an Outpatient Clinic and was making her way through the hospital to her place of work. However, as she walked along a corridor she slipped and fell, landing with some force onto her right knee.

As she got to her feet she experienced pain in her knee. Despite this, she carried on to get to her desk and then completed her shift.

Our client was aware that she had passed areas of the hospital where 'Wet Floor' signs had been present, but at the site of the accident there were no hazard warning signs. Usual cleaning protocol was that one side of the corridor would be mopped 'wet' while the other side was left 'dry', however our client states that both sides of the corridor were wet.

The following day, our client's knee injury was causing her significant pain and she was unable to go into work. Two days later she attended a Knee Fracture Clinic at Queen Elizabeth Hospital and following an x-ray was referred for an MRI scan. The scan revealed that she had overstretched a medial ligament in her knee. She was informed that there was fluid behind the knee and bruising to the bone.

The consequences

Thompsons' personal injury solicitors intimated a claim with our client's employer and liability was admitted.

We obtained a medical report which confirmed that our client had suffered a hyper flexion knee injury. The report noted that the client had underlying arthritis in her right knee. There was also a fracture diagnosed. Recovery time would be 2-3 years.

The settlement

The defender put forward a work accident compensation settlement sum of £6,500 which we felt was a fair offer. The NHS employee advised us that she was happy to accept the offer.

Settlement was agreed on 2 August 2021.
