Ayrshire RTA Whiplash Case Study
Thompsons road traffic accident solicitors in Scotland were contacted by Mr John Kerr through his union, Unite. Mr Kerr, a 49-year-old bus driver from East Ayrshire, had been involved in a road traffic accident on the A71 at Galston in which he sustained a whiplash-type soft tissue injury.
The background
Mr Kerr had been driving towards his home at the time of the accident. He was negotiating a roundabout when a car cut in front of him. Although our client managed to slow down to avoid a collision with this vehicle, a third party travelling behind him failed to stop and this third party vehicle collided with the rear of Mr Kerr's car.
The consequences
The road traffic accident left Mr Kerr's vehicle with damage to the driver's side rear-end, to the boot lid, to the back bumper and to the rear quarter panel. It had to be written off.
The day following the road traffic accident, Mr Kerr awoke with a sore neck and discomfort in his back and shoulders. In fact, he was unable to turn his head. As a result, he decided to attend hospital, where he was told he should take painkillers. He was also referred to a physiotherapist.
The settlement
