A woman who is suing the NHS Greater Glasgow and Clyde for compensation for injuries caused when her smear tests were incorrectly interpreted has been allowed to continue with her case.

Helen McGlone is arguing that if her smear tests has been properly interpreted she would not have had to undergo such radical surgery. The NHS are arguing that surgery would have been needed in any event as the cancer was at an advanced stage.

A Judge recently allowed Ms McGlone to continue with her case. Ms McGlone claims two smear tests in 2005 and 2006 showed pre invasive cancer which if picked up could have been treated without the need for a hysterectomy.

Ms McGlone is arguing that any compensation she received should take into consideration the effect that the operation she had on her fertility and career.  Ms McGlone claims that the operation she had in 2008 left her physically incapable of working and she was allowed six months absence leave. She is seeking compensation for the cost of retraining to work with a children’s charity and for the cost of private medical treatment she has undergone, including fertility treatment.
