Mrs Eileen Jardine was referred to Thompsons personal injury solicitors through her union, Unite. She had been in involved in an accident at work in August 2020.

The background

Our client, a 67 year-old Domestic Hygiene Operative at Brown Brothers Manufacturing Ltd, was working a morning shift on the day of the accident. She was responsible for cleaning the offices.

She had been instructed to clean a corridor where rain had been coming through the roof. Ceiling tiles had fallen onto the floor and there were several buckets in place to collect the rainwater.

As Mrs Jardine walked through the corridor, a square ceiling light fell from above and struck her. Our client instinctively raised her arm to protect her head and the light fitting landed on her shoulder and wrist.

The consequences

Mrs Jardine managed to finish her shift at work and did not need to take any time off. However, she continued to experience a lack of strength and restricted movement in her arm. Her GP prescribed painkillers and she was told to self-refer for physiotherapy.

Thompsons work accident solicitors intimated a claim to Mrs Jardine's employers and liability was admitted. We obtained a medical report from a Consultant Orthopaedic Surgeon who confirmed that our client had sustained injuries to her right shoulder and hand.

Once the medical evidence had been sent to the defender they put forward a full and final settlement offer of £3,000. Having discussed this with Mrs Jardine, the offer was rejected. A further offer was put forward by the defender in the sum of £4,000 and, following discussion, Mrs Jardine accepted the offer.

Settlement was agreed on 12 April 2021.
