Our client, Mr Thomas Hamilton, was involved in a road traffic accident in a car park in Moffat, Dumfries and Galloway, as a pedestrian. He was referred to Thompsons car accident solicitors via his union, UNITE.

The background

Mr Hamilton, who was 63 at the time, had been crossing the car park located at Moffat Woollen Mill on the afternoon of 18 November 2018 when he was struck by a car as it reversed, at speed, out of a parking space.

The driver of the third party vehicle apologised at the scene, saying that she had not seen Mr Hamilton.

The consequences

Mr Hamilton suffered leg injuries; his leg was broken in three places including fractures to his tibia and fibula.

The injuries required surgery which occurred three days after the date of the car accident and during which a pin and plate were inserted into Mr Hamilton's leg. Our client spent ten days in the Royal Dumfries and Galloway hospital and was then transferred to the Lancaster Royal Infirmary where he spent another ten days.

Sadly, the injuries did not heal as well as the hospital had hoped and Mr Hamilton's recovery was somewhat protracted.

The settlement

Liability was admitted pre-litigation by the third party driver's insurer.

A personal injury compensation settlement of £22,500 was secured by Thompsons car accident solicitors and agreed on 31 March 2021.
