Our client, Mrs Mairi Rhind, a retiree from Glasgow, was injured following a fall caused by a pothole. The accident occurred in November 2017 and was close to time bar when Thompsons Solicitors was instructed to pursue the personal injury claim on her behalf.
The background
On the day of the accident, Mrs Rhind had been walking along the Paisley Road West toward the corner of Lammermoor Avenue. She crossed the road to reach a post box on the opposite side of the street and as she stepped off the pavement, the surface of the road crumbled under her feet. She fell to the ground.
Mrs Rhind had inadvertently trodden on the edge of a pothole filled with water. The edge of the pothole had given way as Mrs Rhind put her foot onto it.
The consequences
As a result of the fall, Mrs Rhind injured her wrist. Having been taken by ambulance to A & E, an x-ray showed that she had suffered a fracture to her distal radius bone. At the time of the incident Mrs Rhind underwent a procedure to reset the bones and a cast was applied. At a follow-up appointment Mrs Rhind was warned she would only ever regain up to 80% of the strength in her wrist.
Thompsons personal injury solicitors carried out liability investigations and found that the pothole had been reported to Glasgow City Council, but it had not been fixed.
Thompsons arranged for Mrs Rhind to be examined by a Consultant Orthopaedic Surgeon who confirmed the injury and advised that Mrs Rhind had been left with some symptoms that would be permanent .
The settlement
An initial offer of £6,000 was made to our client by the defender. We advised our client that this was a reasonable offer and Mrs Rhind was pleased to accept the compensation sum in respect of her pothole accident.
Settlement was agreed on 31st March 2021.
