Thompsons Solicitors successfully represented a Unison member who suffered life-altering injuries following a preventable accident on 8th March 2022. The incident took place in Glasgow, just outside her workplace, when a billboard attached to a construction site fence detached and struck her on the head. The severe impact knocked her unconscious, leaving her with multiple physical injuries and lasting psychological trauma.

Injuries Sustained

The accident caused significant injuries, including:

  • A broken jaw requiring surgical insertion of five metal plates.
  • A fractured second vertebrae necessitating a neck brace for several weeks.
  • A fractured eye socket.
  • Shoulder and arm injuries, including a frozen shoulder and inflammation.
  • Psychological distress, including anxiety, low mood, and social withdrawal.

The client required hospitalisation and surgery, including pre-operative assessments and ongoing medical care. Her recovery involved extensive physiotherapy for her shoulder and neck, as well as counselling to address the psychological impact. Despite her progress, she continues to experience pain, numbness, and a reduced quality of life.

Legal Action

Thompsons Solicitors immediately pursued legal action, identifying the construction company as responsible for failing to adequately secure the billboard. Liability was admitted by the company’s insurers; however, initial settlement offers of £45,000 and £75,000 were insufficient to reflect the gravity of her injuries and losses.

Court proceedings were raised in the Court of Session to ensure fair compensation. Following expert medical evaluations and discussions with the client, a final offer of £104,055.83 was made and accepted. This included:

  • £769.95 to repay benefits.
  • £4,055.83 to cover repayable sick pay.
  • £99,230.05 directly awarded to the client for her suffering and losses.

Impact of the Injuries

The injuries profoundly impacted the client’s daily life:

Physical Pain and Limitations: She struggles with mobility, ongoing pain, and reduced function in her shoulder and neck.

Work and Financial Challenges: Unable to return to work, she relies on her husband for financial and physical support.

Daily Living: Basic tasks, such as dressing and preparing meals, require assistance.

Social and Emotional Effects: The visible scar on her face has caused self-consciousness, leading to social withdrawal and isolation.

Quote from Seonaid Brophy

“This case underscores the importance of holding companies accountable for public safety. Our client’s injuries were entirely preventable, and her life has been irrevocably altered. We are proud to have secured a settlement that provides financial security and acknowledges the profound impact of her ordeal.”
