The background
The claimant had worked as an HGV driver for his employer for eleven years. During this time, his job usually consisted of making milk deliveries to the supermarket chain Tesco.
On the day of his accident, he was reversing the HGV through a supermarket's delivery doors when a defect with the vehicle – a defect which had previously been reported by the claimant's colleague – resulted in it jerking suddenly, causing him to sustain soft tissue whiplash injuries to his neck and shoulders.
The consequences
Although our client was initially able to continue with his shift, he later developed pain in his neck and shoulders and was taken by a colleague to Royal Glasgow Infirmary where, after a physical examination, he was diagnosed with whiplash-type injuries. He was given pain killers and advised to carry out some exercises to assist with mobility..
Unfortunately, his symptoms persisted for several weeks leaving him unable to work and reliant on the help of his wife in order to carry out domestic tasks.
The settlement

Shortly afterwards, they later made pre-litigation offer of £3,000, which was accepted by the claimant and finalised on 22 November 2019.
