Leading accident injury solicitors Thompsons has successfully secured compensation for an MOD employee injured at work.

Gabriel Chambers sustained a back injury following an accident in August 2011. Mrs Chambers was employed by the MOD and on the day of the accident she was the first to arrive at RNAD Coulport where she was responsible for opening the main gate. The gate was very large and heavy and as she tried to move it Mrs Chambers experienced a sharp pain in her back.

As a member of her union PCS, Mrs Chambers was entitled to full legal support from specialist trade union lawyers Thompsons. Thompsons intimated a claim on Mrs Chambers’ behalf on the grounds that she had received no training on manoeuvring the gate nor had it been adequately maintained to ensure it was in efficient working order.

Liability was admitted by the MOD’s insurers and after medical records were submitted showing Mrs Chambers had experienced symptoms from her injury for as much as a year afterwards she was awarded £4,000. Gabriel Chambers said: “I can’t praise Thompsons highly enough. It was really simple. I was very stressed when I began the claim but they did everything for me and made the whole process go really smoothly. I found the service to be excellent and would be happy to recommend them to anyone.”

Following the accident her employers reverted to an old system where the gate was operated by two full trained members of staff. Thompsons Solicitor Laura McGee said: “This accident was completely avoidable and it is unfortunate in Mrs Chambers case that an adequate system wasn’t being operated to prevent her injury. However, she has been recompensed and lessons have been learned to avoid a repeat of this incident which is a positive outcome”.
