A Teacher who involved herself in a fight between 2 pupils had her claim for compensation arising out of an injury sustained in breaking up the fight, denied by Glasgow City Council. The Teacher was accidentally struck in the mouth while attempting to separate the pupils at a Special School in Glasgow last year.
She sustained significant damage to her teeth and wrote to the Council seeking remittance for the dental work required. However, the Council advised that because they do not consider that they were negligent in causing the injury to the Teacher they would not be compensating her for her injuries.
The decision by the Council has led the Teacher’s Union to issue a warning to its members not to intervene in playground fights. The move by the Union was made in direct response to the Council’s repudiation of the Teacher’s claim for reimbursement of the dental work.
The Council’s blanket denial of the claim appears to have aggravated a minor issue and could now result in them facing a personal injury compensation claim brought by the Teacher with the assistance of her Union that will involve a lot more expense than the £2500 sought by the Teacher in the first place for the remedial dental work.
